BIOGRAPHY: Andy Dogali was born in San Diego, California in 1962. He received his B.A. Degree, magna cum laude, from Florida State University in 1983. He received his Juris Doctor, with honors, from the Florida State University College of Law in 1986. He was admitted to the Bar in 1986 and later co-founded the firm of Forizs & Dogali, P.A.
Mr. Dogali is admitted to practice in all state and federal courts in Florida, and has appeared in litigated matters in more than a dozen other jurisdictions. He is a member of the American, Florida, Hillsborough County, St. Petersburg and Clearwater Bar Associations. He has been a member of many bar sections and committees, including a number of chairmanships and board positions. He is currently the Chair of the Florida Bar’s Law Office Management Assistance Service Advisory Council. Mr. Dogali’s law practice includes a wide range of civil litigation matters, chiefly in the areas of insurance defense, insurance coverage, construction law, and economic fraud litigation, as more fully described below.
In construction law, Mr. Dogali’s litigation practice has encompassed all types of construction disputes involving performing arts centers, power plants, industrial facilities, retail and movie complexes, bridges, college and educational facilities, hospitals, nursing home and retirement facilities, residences, commercial office structures, condominiums, roads and highways. Mr. Dogali has represented all aspects of the construction industry: architects and engineers, developers, owners, contractors, subcontractors, surveyors, and insurers, and has done so for all types of claims: cost overrun and delay claims, defect claims, lien claims, performance and payment bond disputes, claims of professional malpractice in design and construction administration, and personal injury matters. Mr. Dogali has also lectured for design professionals.
In insurance law, Mr. Dogali’s practice has encompassed both coverage and defense. In coverage matters, Mr. Dogali has most often represented the insurance industry in liability coverage and bad faith disputes, involving CGL policies, professional liability policies, first party casualty and collapse coverages, and others in relation to claims arising from construction defects, mold, pollution and environmental risks, professional negligence, building collapse, asbestos, and products liability.
In defense matters, he has defended a myriad of professional malpractice claims, on behalf of medical and legal professionals, architects, engineers, surveyors, accountants, and real estate agents and brokers. He has also defended general liability claims arising out of products liability, vehicular negligence, premises liability, and completed operations. Finally, Mr. Dogali has defended a number of self-insured municipalities in Florida, in connection with claims relating to all facets of municipal and governmental liability, such as defective public facilities, inverse condemnation, police torts, civil rights claims, public records and Sunshine Law questions, and vehicular negligence.
In commercial litigation, Mr. Dogali’s practice has been diverse. Exemplary commercial cases include representation of lenders and borrowers in usury disputes, lenders in foreclosures and collections matters, corporations, shareholders, directors and officers in shareholder derivative suits, and malfeasance matters.
In investment, fraud and class action litigation, Mr. Dogali has represented corporate entities and victims in connection with investment and consumer fraud and class action litigation. Mr. Dogali also has represented hundreds of victims of economic fraud, including victims of sales of improper and unsuitable securities, investment, annuity and insurance products, in both individual lawsuits and class actions. These claims have often involved disguised retirement plans, hidden surrender or other charges, deceptive vanishing premium and replacement transactions, and unsuitable investments and equities. Mr. Dogali previously served as nationwide Liaison Counsel for all individual plaintiffs against the Prudential Insurance Company of America, in connection with claims regarding that company’s life insurance sales practices.
